Terms of Service

The agreement governing your use of FlowPital.

Not for emergencies. FlowPital is not an emergency service and is not monitored in real time. If you are experiencing a medical emergency or a life-threatening situation, call 112 (emergency services in Türkiye) or your local emergency number, or go to the nearest emergency department immediately. Do not use FlowPital to request urgent help.

1. Acceptance of these terms

Accepting these Terms is not consent for special-category data processing or international transfer; those notices and choices must be separate.

These Terms of Service ("Terms") form a binding agreement between you and FlowPital governing your access to and use of the FlowPital web application and its iOS and Android apps (together, the "Service"). By creating an account, accessing, or using the Service, you confirm that you have read, understood and agree to these Terms and to our Privacy Policy and Cookie Policy. If you do not agree, do not use the Service.

2. What FlowPital is, and is not

FlowPital is a health-tracking and clinical follow-up platform that connects patients and their care team, across all medical specialties, to coordinate care, communicate in plain language, support shared decision-making, and manage symptoms, adherence, wellbeing and appointments.

Decision support, not a decision-maker. FlowPital assists clinicians and patients; it does not practice medicine, does not diagnose, and does not prescribe. Any AI-generated protocol suggestion, summary or draft is advisory only and is presented with its reasoning and stated uncertainty. The treating clinician makes all clinical decisions (selection, approval, prescription and the care plan) through an explicit human review gate. FlowPital is not a substitute for the professional judgment of a qualified clinician, and it is not intended to be an autonomous medical device or to replace in-person care.

The Service is not designed for urgent or emergency situations and does not guarantee that any message will be seen or acted upon within any particular time. Response-time indicators shown in the app are informational and do not create a clinical obligation of immediacy. In an emergency, call 112 or your local emergency number.

Clinicians

Licensed clinicians retain full professional and legal responsibility for every clinical decision. AI suggestions are advisory inputs to be independently evaluated; the clinician must exercise their own judgment, verify information, and comply with applicable standards of care, licensing and record-keeping duties. Approving a treatment plan is an explicit clinician action.

Patients & caregivers

Patients should provide accurate information, follow their clinician's instructions, and understand that FlowPital supports (but does not replace) working with their care team. Information in the app is educational and supportive; it is not a personal medical order unless confirmed by your clinician. Caregivers act only within the scopes the patient has consented to.

7. Intellectual property

The Service, including its software, design, text, and trademarks (including the "FlowPital" name and logo), is owned by FlowPital or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose. You retain your rights in the clinical and personal content you contribute; you grant us the limited rights needed to host, process and display that content to deliver the Service. You may not copy, modify, distribute, or create derivative works except as permitted by law or these Terms.

FlowPital does not provide medical advice. Content and AI-generated suggestions are for informational and decision-support purposes and must not be treated as a diagnosis, prescription or definitive clinical instruction. Always seek the advice of your physician or another qualified health provider with any questions about a medical condition, and never disregard professional medical advice or delay seeking it because of something you read in the Service.

9. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted or error-free operation, to the maximum extent permitted by applicable law. We do not warrant that AI outputs are complete, accurate or suitable for any particular clinical situation. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.

10. Limitation of liability

To the maximum extent permitted by applicable law, FlowPital and its affiliates, officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of, or inability to use, the Service. Nothing in these Terms excludes or limits liability that cannot be excluded under mandatory law, including liability for death or personal injury caused by negligence, for fraud, or for a clinician's own professional decisions, which remain the clinician's responsibility. Where liability cannot be excluded, it is limited to the maximum extent permitted by law.

11. Termination

You may stop using the Service and request account closure at any time. We may suspend or terminate access if you breach these Terms, if required by law, or to protect patient safety or the integrity of the Service. On termination, your rights to use the Service cease; provisions that by their nature should survive (such as intellectual property, disclaimers, limitation of liability, and governing law) will survive. Handling of your data after termination is described in our Privacy Policy, subject to clinical-record retention obligations.

12. Governing law & dispute resolution

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-laws rules. The courts and enforcement offices of Istanbul (Çağlayan), Türkiye have jurisdiction over any dispute, without prejudice to any mandatory consumer-protection rights you may have in your place of residence to bring proceedings before your local courts. The parties will first attempt to resolve disputes amicably by contacting us at the address below.

13. Changes to these terms

We may update these Terms to reflect changes in the Service or the law. We will post the updated Terms here and revise the "Last updated" date; where changes are material we will provide reasonable notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
